Settlement Agreements (formerly known as Compromise Agreements)

VIDEO: Nick Rowe discusses settlement agreements

At Lodders Solicitors, our employment solicitors have forged a particularly strong reputation acting for clients who have found themselves in a position where their employer is seeking to terminate their employment and has provided them with a Settlement Agreement.

Our clients value our overall approach and the experience and resulting expertise that we employ when negotiating with employers and their advisers on their behalf.

“Being a senior executive manager, my exit from my employer required considered and skilled assistance.  Having dealt with Nick Rowe before, I had no hesitation instructing him to deal with my settlement/compromise agreement.  Nick and his team negotiated a cracking conclusion and almost doubled the package originally offered to me by my employer.  Nick is a quite excellent solicitor with a superb commercial approach and it is clear to me that he is supported by an equally impressive team.”  Client and Senior Executive in financial services, London.

In order for us to achieve the optimum outcome for our clients, we consider it an essential part of the service for us to really understand the background. In order to do so effectively, we need to assess all the relevant documentation (including the relevant policies and contractual provisions).  Only then can we really understand the circumstances which have led to our clients being in the position in the first place and only then can we identify any leverage that may exist in order to allow us to re-negotiate the terms upon which it is proposed that the employment is terminated.

In negotiating the terms of any severance, we will always also seek to protect our client’s position and their ability to acquire alternative employment with the assistance of a solution which not only includes an optimum commercial outcome and the most compensation possible; but that includes a favourable reference and the absence of restrictions on the client’s post-employment conduct.

Our substantial experience also assists us in structuring the termination package in order to provide the most attractive and efficient conclusion in terms of the tax payable (or not payable) by our client in connection with the compensation for loss of employment. In our experience, a party’s first offer is rarely its best offer!
