Successful Conference for Third Sector Strategy Group

An initiative organised by Dafferns accountants along with Lodders’ Mark Lewis, held its first (virtual) conference on Thursday 29 October and drew 30 delegates from across the charity and not for profit sector.

The conference speakers included Daniel Fluskey, the Head of Policy and External Affairs at the Chartered Institute of Fundraising, who gave a very interesting talk on the “next normal” in fundraising. Daniel was followed by Dafferns’ strategic services partner Richard Miller who gave a talk on embracing change and how best charities can adapt.

The Third Sector Strategy Group Conference was organised by Richard Miller, with support from our charity law specialist Mark Lewis, who discussed how charities can survive through collaborative working and mergers.

Mark spoke alongside Dafferns’ tax partner, Brian Jukes, on the different types of collaborative working and mergers for charities, and the issues that can arise:

“The key advantages of collaborative working are that it is possible to share services but, at the same time, maintain separate identifies and separate trustees, and there are a variety of ways of achieving this.

“So far as mergers are concerned this can either be by way of a takeover, with one charity taking on the activity of the other, and acquired charity ‘disappearing’, or through a merger where a new charity created.  The latter is a more equal way of proceeding as both charities in this scenario transfer their activities to a new charity.

“Inevitably there are difficult and time-consuming negotiations and there are difficulties not least because one of the charities may effectively be voting for its own extinction. Thorough due diligence and stakeholder consultations will always be required.”
