The probate process – what do you need to do when someone dies?

Lodders’ Vicki Gulliver and John Rouse, partner in our Private Client team, explain the process of probate administration, and answer some frequently asked questions.

In a recent webinar, our experts explain the administration process when someone passes away, as well as the different steps involved in probate. They clarify the role of executors and administrators, and how they can help, as well as the rules are regarding intestacy.

Vicki and John go through what the next steps should be, such as funeral planning during lockdown, and what other priorities should be upon the death of a relative, such as securing their home, the contents, and ensuring any family pets are cared for.

John explains the process of registering a death, and how this can be done over the telephone, as well as obtaining the grant of probate and letters of administration.

They also cover some common questions, such as ‘where do I begin in dealing with the assets of an estate?’, ‘how is inheritance tax calculated?’, and ‘how does the application for probate work?’

They also highlight some common issues, such as dealing with valuations, getting tax clearance, claims from disgruntled beneficiaries, and keeping a detailed financial record.
