Setting up a lasting power of attorney in lockdown

Lodders’ Care and Capacity law specialist, Michael Brook, outlines the process of setting up a lasting power of attorney whilst maintaining social distancing measures.

A lasting power of attorney (LPA) is an important document which legally authorises the people you trust to act for you. Lodders are still here to help you set up LPAs under the current lockdown, and in a recent webinar, Michael Brook from our Care & Capacity team, explains how the process works.

Starting the LPA process

Often there are specific requirements for LPAs, which can be set up for your financial decisions as well as personal health and welfare decisions. Lodders’ team of experts are able to liaise with you over video call, as well as over the phone, in order to talk through your options.

It is important these documents meet your needs, so we will prepare a draft, and send this to you via email or post. We can then address any queries you may have, and finalise the documents.

Signing documents in lockdown

Once you have received the final documents, you will be provided with clear instructions on how to sign the documents in the correct order, whilst maintaining social distancing.

We will set out clearly in the documents where to sign, as well as in what order.

For the sections where a witness is needed, you can ask a friend or neighbour. They just need a clear line of sight to the document, for example, over a garden fence, through a window, or on a car bonnet. This should be done in a neutral location where both parties can walk up and sign the document. It is advisable to us different pens, and gloves where possible.

These documents can then be returned to Lodders.
