Watch now: What are the rules on adverse possession?

In the second webinar in the dispute resolution series, Lodders’ experts Jane Senior, Vicky Khandker, and Ellie Crofts outline potential traps to be avoided when it comes to adverse possession, or ‘squatters rights’.

The webinar outlines applications for adverse possession in relation to both unregistered and registered land.

Our expert speakers run through cases and experiences, pointing out a number of potential traps to be avoided.

Watch now

You can watch the video in full below. The running time is around 44 minutes and includes a Q&A session with the speakers.

Unregistered land and adverse possession

The session kicks off with a talk from Vicky Khandker, a partner in Lodders’ Property Dispute team. Vicky explains that where land is unregistered, a party in occupation can acquire the title by adverse possession over a period of time. This is can happen automatically, regardless of whether or not an application has been made.

Vicky then discussed some of the rules regarding unregistered land, and transitional provisions and where they are applicable.

Ellie

This is followed by a talk from Ellie Crofts, senior associate in the Property Dispute team. Ellie discussed adverse possession in relation to registered land, and the impacts of the Land Registration Act 2002 on this process.
