Presumption of Death Act 2013

Laura Abbott private client solicitor with Lodders Solicitors

The Presumption of Death Act 2013 came into force on 1 October 2014. The Act makes provision for the presumed death of missing persons. It allows the High Court to make a single declaration, effective against all persons and for all purposes, that a missing person is presumed to have died at a particular date and time if it is satisfied that the missing person has not been known to be alive for a period of at least seven years. This is in line with legislation already in force in Scotland and Northern Ireland.
