Environmental law involves evaluating the risk of remediation for clients, their lenders, and the impacts this can have when properties are sold or let later down the line. It can touch on a range of issues, such as contaminated land, permitting waste, and other environmental issues that can arise in real estate and corporate transactions.

This service can be used as part of a wide range of reasons, such as construction and planning, agricultural pursuits, environmental impact studies, etc.

If you are developer, planning remediation conditions will go straight to the bottom line, and you will need to do your due diligence on the environmental aspects.

If you are purchasing a factory, you will want to know that any regulatory issues (such as those involving environmental permitting, compliance with asbestos regulations, and COMAH issues) have been adequately dealt with in order to avoid a visit from a regulator, or being issued penalties and fines.

If you are purchasing a company, you will not want to be responsible for environmental liabilities arising out of properties that were sold out of the target before the share acquisition was completed.

There are a number of instances in which you may need an environmental lawyer, but generally, when you are looking to develop on land which has previously been developed on or bringing a new lease of life to existing developed land. Environmental lawyers can help ensure you do your due diligence before a corporate transaction, for example:

• If you own agricultural land and are granting rights to utility/energy companies you will want to have sufficient protection against pollution incidents built into the relevant licences and easements.
